These Driver Terms & Conditions (the "Terms") constitute a legally binding agreement between you (the "Driver") and EVODOO SARL ("EVODOO", "we", "us", or "our"), governing your application to, registration on, and performance of delivery services through the Drayk Driver mobile application (the "Driver App"). They are supplemented by the Driver Privacy & Cookie Policy, which forms an integral part of these Terms.
BY APPLYING TO BECOME A DRIVER, CREATING A DRIVER ACCOUNT, OR USING THE DRAYK DRIVER APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY, INCLUDING YOUR STATUS AS AN INDEPENDENT SERVICE PROVIDER. IF YOU DO NOT ACCEPT THESE TERMS, YOU MUST NOT USE THE DRIVER APP.
EVODOO may modify these Terms at any time. Material changes are notified via in-app notice and/or email. Continued use after notification constitutes acceptance. If you disagree, you must stop going online and may delete your account per the Driver Privacy Policy.
ARTICLE 1. LEGAL NOTICE AND PUBLISHER INFORMATION
1.1 Publisher
The Drayk Driver app is published, owned, and operated by EVODOO SARL, a limited liability company under Moroccan law, registered at DOUAR FASK, Guelmim, Morocco, 81003, under Registre du Commerce No. 5719 and I.C.E. No. 003904593000051.
1.2 Platform Role
Drayk is a digital intermediary platform under Moroccan Law No. 31-08. EVODOO connects customers, partner restaurants, and independent drivers through technology. EVODOO does not prepare food, does not own the goods transported, and does not employ drivers. Each delivery is performed by the Driver as an independent professional, in their own name and under their own responsibility.

ARTICLE 2. DEFINITIONS
- "Driver App" means the Drayk Driver mobile applications (iOS and Android), features, and related driver services operated by EVODOO.
- "Driver" means an approved independent delivery person performing deliveries through the Driver App.
- "Offer" means a time-limited delivery proposal dispatched to an online Driver, showing route, earnings, and cash requirements.
- "Active Job" means an accepted offer from pickup through handover (or authorized return/failure closure).
- "Pickup" means collection of the order from the restaurant or sender; "Handover" means delivery to the customer or recipient against any required PIN.
- "Customer" means the user who placed the order; "Restaurant" means the partner merchant fulfilling a food order.
- "Earnings" means delivery, waiting-time, destination-change, and reimbursement amounts credited to the Driver's wallet.
- "Cash Exposure / Cash Debt" means cash collected from customers minus cash paid to restaurants, held by the Driver in custody for EVODOO.
- "Settlement" means the periodic closing of earnings and cash custody; "Payout" means the bank transfer of net amounts owed to the Driver.
- "OTP" means the single-use WhatsApp code used for driver login.
ARTICLE 3. INDEPENDENT STATUS — NO EMPLOYMENT
3.1 Independent Provider
You act exclusively as an independent service provider. Nothing in these Terms creates an employment, agency (other than the delivery mandate per job), partnership, or exclusivity relationship between you and EVODOO. You are free to work with competing platforms, to choose when and where to go online within operating zones, and to accept or decline offers — subject only to the quality and reliability consequences described in these Terms.
3.2 Professional Registration
You represent that you hold, and will maintain, a valid independent professional status as required by Moroccan law (notably the auto-entrepreneur regime under Law No. 114-13 where applicable, or any equivalent lawful status), and that you will provide EVODOO with supporting evidence on request. Operating without lawful professional status is grounds for immediate deactivation.
3.3 No Subcontracting or Account Sharing
Your driver account is strictly personal. You may not share it, lend your phone session, subcontract jobs to another person, or let anyone else deliver under your identity. Every pickup, handover, and PIN entry must be performed by you personally. Violations lead to immediate permanent deactivation.
ARTICLE 4. ELIGIBILITY & ONBOARDING
4.1 Eligibility
To apply you must: be at least 18 years old; hold full legal capacity; possess a valid Moroccan national ID card or passport; hold a valid driver's license and insured, roadworthy vehicle if registering as a motorcycle driver; hold a valid phone number able to receive WhatsApp OTPs; and be lawfully entitled to perform independent delivery work in Morocco.
4.2 Invitation-Only Registration
Driver accounts are created by invitation following your application on the channel indicated by EVODOO. Self-registration with an uninvited phone number is rejected. You must provide accurate, complete information and keep it updated — particularly your phone number, city, vehicle details, and bank RIB.
4.3 Document Verification
You must submit the KYC documents listed in the Driver Privacy Policy (identity document, portrait, independent-status evidence, plus license, registration, and insurance for motorcycle drivers) and renew any expired document promptly. EVODOO reviews submissions and may approve, request corrections, or reject with reasons. Only approved drivers may go online. Submitting forged, altered, or third-party documents is fraud and is referred to the competent authorities.
4.4 Re-verification
EVODOO may at any time require renewed documents, a fresh portrait check, or re-confirmation of your details. Failure to comply within the stated deadline suspends online access until resolved.
ARTICLE 5. EQUIPMENT, VEHICLE & INSURANCE
- Smartphone & Connectivity: you must use a compatible device running a supported app build, with mobile data, working GPS, and notifications enabled. Outdated builds below the enforced minimum are blocked from going online.
- Vehicle: your bicycle or motorcycle must be roadworthy, legally registered where required, and maintained at your own cost (fuel, maintenance, repairs).
- Insurance: motorcycle drivers must maintain valid third-party liability insurance at minimum, covering delivery use, and upload proof. You are strongly encouraged to carry personal accident and goods-in-transit coverage. EVODOO does not insure your vehicle, your person, or transported goods.
- Traffic & Safety Laws: you must obey the Moroccan Highway Code (Law No. 52-05) at all times — speed limits, helmets for two-wheelers, no phone use while riding/driving, no impaired operation. Traffic fines and infractions are yours alone.
- Hygiene: you must transport food in clean, closed containers/bags, separated from non-food items, chemicals, and animals (live animals are prohibited cargo).
ARTICLE 6. AVAILABILITY — GOING ONLINE & OFFLINE
6.1 Freedom to Choose
You decide when to work. Going online signals availability for dispatch; going offline ends it. You may also select stop-after-job to finish your current delivery without receiving new offers.
6.2 Conditions to Go Online
Each online request is validated. You must simultaneously satisfy: approved lifecycle status with complete valid documents; verified bank (RIB) details; an assigned operating city; active push registration on the session device; a fresh, accurate GPS fix inside your operating city and its delivery zones; the city service open; a supported app build; no overdue cash deposit; and a wallet balance above the negative exposure threshold. Failure on any condition blocks online access with the reason shown in-app.
6.3 Continuous Location Obligation
While online, holding an offer, or executing a job, you must keep the app's location permission granted and keep sending fresh positions. Going offline stops periodic uploads. Drivers online but stale (no fresh position beyond the safety window) are automatically switched offline. Deliberate GPS spoofing, mock locations, or signal jamming is fraud.
6.4 Offline With an Active Job
You cannot go fully offline while holding an active job — only stop-after-job is available — until the job is completed, returned, or closed as failed per these Terms.
ARTICLE 7. OFFERS & ASSIGNMENT
7.1 Dispatch
Our system dispatches each order to the best-placed eligible online driver based on proximity/ETA, capability, and cash-readiness. Dispatch is automated; EVODOO does not guarantee any volume, frequency, or minimum earnings.
7.2 Offer Content & Decision
Each offer shows the guaranteed earnings, pickup and destination zones with distances/durations, order type (store delivery or courier), and any cash you must advance to the restaurant. You may accept (confirming you hold any required cash) or decline before the countdown expires. Expiry without response returns the offer to dispatch.
7.3 Fair Use
Systematic cherry-picking detection evasion, multi-device offer manipulation, collusion with customers or restaurants to generate artificial jobs, or use of automation/bots constitutes fraud and leads to suspension and deactivation with forfeiture of disputed earnings.
ARTICLE 8. FULFILLMENT DUTIES
8.1 Pickup
Navigate promptly to the pickup point; confirm arrival through the app's geofenced check-in; verify every item against the app's item list before confirming pickup; and confirm any restaurant cash payment exactly as shown. Never confirm pickup of items you have not physically received.
8.2 Transport & Handover
Proceed directly to the destination without unjustified detours or intermediate errands; protect food and parcels from damage, spillage, heat, and contamination; on arrival, confirm presence via geofenced check-in; contact the recipient through the app's call/WhatsApp channel where needed; and complete handover only against the required customer PIN for card-paid orders (5 failed attempts lock the PIN — request an override through support, never guess or coerce the customer).
8.3 Customer-Unavailable Protocol
If the recipient cannot be reached: log at least one genuine phone or WhatsApp contact attempt in-app; start the customer-unavailable timer; wait until the server deadline; and follow the app's binding instruction (redelivery attempt, return to sender for courier orders, or failure closure for store orders). Marking a customer "unavailable" without genuine attempts, or completing handover without meeting the recipient, is a serious breach.
8.4 Prohibited Actions During Jobs
You must not: open, consume, or tamper with orders; demand extra payments, tips, or fees from customers or restaurants; request customers cancel and reorder; complete a job remotely from outside the geofence; or abandon an assigned order without using the app's release/return flow (courier pre-pickup release for legitimate reasons, including safety concerns, is permitted with a truthful reason).
ARTICLE 9. COURIER ORDERS & PROHIBITED ITEMS
9.1 Courier Mandate
For courier (non-restaurant) orders you act under a mandate from the ordering customer to collect and deliver the described item between the stated addresses. Verify the item matches its description before pickup; refuse mismatch, unlawful, or dangerous goods through the proper flow.
9.2 Prohibited Items
You must refuse and immediately report: narcotics and controlled substances; weapons, ammunition, and explosives; flammable, toxic, or otherwise hazardous materials; live animals; items requiring cold-chain transport you cannot provide; goods exceeding 5,000 MAD in value without EVODOO's prior written agreement; and anything illegal to transport under Moroccan law. Transporting prohibited items is your personal liability and leads to permanent deactivation and referral to authorities.
ARTICLE 10. CASH HANDLING & CUSTODY
10.1 Cash in Your Hands Is Not Yours
Cash you collect from customers (delivery fees and cash order totals) and cash advances shown in-app belong economically to the platform flow. You hold them in custody for EVODOO and must settle them per this article. Your live cash debt, exposure limit, and deposit due dates are shown in the app's wallet at all times.
10.2 Paying Restaurants
Where the job requires it, pay the restaurant exactly the cash amount shown in-app at pickup and confirm payment in-app. Keep receipts until the job's settlement closes.
10.3 Settling Your Cash Debt
You must settle cash debts before the stated due date via the server-driven methods offered (bank deposit to the designated city account, or physical office handover to a designated agent), attaching a legible receipt photo for every deposit. Pending (unverified) deposits do not credit your wallet or restore full online eligibility — only verified confirmation does. Reaching the exposure limit or missing a due date restricts or blocks new offers until settled.
10.4 Misuse of Funds
Retaining, spending, lending, or using custodial cash for personal purposes, falsifying deposit receipts, or reusing one receipt for multiple deposits is misappropriation. It leads to immediate suspension, deactivation, deduction from payouts, and, where amounts warrant, civil and criminal referral under Moroccan law.
ARTICLE 11. EARNINGS, SETTLEMENTS & PAYOUTS
11.1 How You Earn
For each completed job you earn the guaranteed amount shown at offer acceptance, plus eligible waiting-time pay computed automatically from verified pickup-wait sessions at the city rate, plus any destination-change or reimbursement amounts. Rates depend on city, order type, vehicle, distance, and duration, and are displayed in-app. Estimates are indicative until the job closes; only closed entries are definitive.
11.2 Adjustments
EVODOO may correct entries for operational errors (duplicate credits, wrong amounts) and void earnings tied to cancelled, refunded, or fraudulent orders. Positive goodwill adjustments may be granted at EVODOO's discretion. All adjustments appear in your wallet ledger with reasons.
11.3 Settlements & Payouts
Earnings accrue to your wallet; net amounts owed to you are closed into periodic settlement statements and paid by bank transfer to your verified RIB. Payouts carry bank references; failures (e.g., invalid RIB) are shown with reasons for correction. You must maintain accurate bank details — payouts to wrong accounts caused by your incorrect data are recovered from subsequent payouts. Statements and payout history are available in-app.
11.4 No Card Handling
You never charge customer cards and never receive card credentials. Card-paid orders are settled upstream; your handover proof for such orders is the customer PIN.
ARTICLE 12. TAXES & SOCIAL CHARGES
You are solely responsible for declaring your earnings and paying all applicable taxes, duties, social contributions, and professional levies arising from your independent activity (including under the auto-entrepreneur regime where applicable), and for issuing any invoices or receipts your status requires. EVODOO provides earnings statements to assist your filings but gives no tax advice. You shall indemnify EVODOO against any claim, reassessment, or penalty resulting from your tax or social non-compliance.
ARTICLE 13. CONDUCT & SAFETY RULES
You must, without exception:
- (a) Obey traffic laws and prioritize safety over speed — never ride impaired, fatigued, or recklessly to meet an estimate;
- (b) Treat customers, restaurant staff, and EVODOO personnel with respect — harassment, threats, discrimination, or abusive language leads to deactivation;
- (c) Never share, lend, or sell your account, OTP codes, or session, and secure your device with a lock screen;
- (d) Never scrape, copy, or exploit platform data, interfere with dispatch, use bots, spoof GPS, or attack EVODOO systems;
- (e) Never contact customers outside assigned jobs or retain their details afterwards;
- (f) Never transport prohibited items or perform deliveries outside the app to divert platform orders;
- (g) Report accidents, injuries, and safety hazards immediately through in-app reporting and the published support channels.
ARTICLE 14. QUALITY MONITORING
EVODOO monitors service quality through objective operational signals: offer acceptance and completion reliability, on-time pickup and handover, geofence compliance, customer-unavailable protocol compliance, cash-settlement discipline, incident records, and customer complaints. There is currently no customer star-rating of drivers; if ratings are introduced, you will be notified and these Terms updated. Persistent quality failures trigger coaching, temporary throttling or suspension, and ultimately deactivation. Automated dispatch ranking uses proximity and eligibility only — it does not constitute automated legal decision-making over your status; suspensions and deactivations always involve human review with a right of appeal.
ARTICLE 15. SUPPORT & INCIDENT REPORTING
Report any job problem (wrong items, damaged goods, accident, breakdown, safety threat, app failure) immediately via the in-app issue flow for the active job and, for emergencies, call local emergency services first, then EVODOO support. False or exaggerated incident reports are treated as fraud. In-app support history and published city support numbers are your channels; response times vary with severity and operating hours.
ARTICLE 16. SUSPENSION, DEACTIVATION & APPEALS
16.1 Graduated Measures
Quality or compliance failures may lead to warnings, temporary throttling, suspension (no offers), or deactivation (account closed), proportionate to severity and recurrence. Cash-limit and document-expiry blocks are automatic and lift upon settlement or renewal.
16.2 Immediate Deactivation
The following lead to immediate permanent deactivation without prior warning: account sharing or subcontracting; forged documents; GPS spoofing or dispatch manipulation; cash misappropriation or receipt fraud; prohibited-item transport; harassment or assault; and any criminal use of the platform. Disputed earnings linked to fraud are forfeited.
16.3 Appeals
You may appeal any suspension or deactivation within 15 days by emailing contact@evodoo.ma with your registered phone number, the measure reference, and supporting evidence. EVODOO reviews appeals with human oversight and responds within 30 days. The measure remains in force during review unless overturned.
ARTICLE 17. INTELLECTUAL PROPERTY, CONFIDENTIALITY & DATA
17.1 App License
EVODOO grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Driver App solely to perform deliveries under these Terms. You may not copy, modify, reverse-engineer, or exploit the app, brand, or content. All IP remains EVODOO's exclusive property under Moroccan and international law.
17.2 Confidentiality
Offer terms, earnings structures, dispatch logic, and any non-public platform information are confidential. Customer personal data is subject to the strict processor duties in Section 9 of the Driver Privacy Policy, which survive termination.
17.3 Personal Data
EVODOO processes your data as controller under Law No. 09-08 as detailed in the Driver Privacy Policy. You consent to the operational processing (including continuous location while online) necessary to perform these Terms.
ARTICLE 18. LIABILITY, DISCLAIMERS & INSURANCE
18.1 App Provided "As Is"
THE DRIVER APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF CONTINUOUS UPTIME, ERROR-FREE OPERATION, OR GUARANTEED ORDER VOLUME OR EARNINGS. DISPATCH DEPENDS ON CUSTOMER DEMAND, RESTAURANT AVAILABILITY, AND YOUR POSITION AND ELIGIBILITY.
18.2 Your Liability
YOU ARE SOLELY LIABLE FOR YOUR DRIVING, YOUR VEHICLE, AND GOODS IN YOUR CUSTODY FROM PICKUP TO HANDOVER (OR AUTHORIZED RETURN). YOU BEAR THE RISK OF LOSS, DAMAGE, THEFT, OR DELAY DURING TRANSIT, TRAFFIC FINES, AND ANY HARM CAUSED TO THIRD PARTIES — SUBJECT ONLY TO MANDATORY MOROCCAN LAW. MAINTAIN ADEQUATE INSURANCE.
18.3 EVODOO's Liability Cap
To the maximum extent permitted by Moroccan law, EVODOO's aggregate liability to you under these Terms is capped at the total earnings credited to your wallet in the 3 months preceding the claim event, and EVODOO is never liable for indirect, incidental, consequential, or lost-profit damages (including income from alternative platforms).
18.4 Indemnity
You shall indemnify and hold harmless EVODOO, its personnel, partner restaurants, and customers against claims, fines, and damages arising from your breach of these Terms, your driving, goods in your custody, cash handling, tax non-compliance, or misuse of personal data.
ARTICLE 19. DURATION, TERMINATION & DELETION
These Terms take effect upon your acceptance and remain in force while your driver account exists. You may end them at any time by staying offline and deleting your account per Section 13 of the Driver Privacy Policy (15-day cancellable grace period). EVODOO may end them by deactivation under Article 16. Articles surviving termination include confidentiality and customer-data duties, cash-settlement obligations, tax duties, liability and indemnity, and governing law. Statutory records are retained per the Privacy Policy.
ARTICLE 20. GENERAL PROVISIONS & GOVERNING LAW
20.1 Amendments & Notices
EVODOO may amend these Terms with in-app and/or email notice; continued online activity constitutes acceptance. Operational notices (offers, payouts, compliance) are delivered via push, in-app, or email — keep your contact details current.
20.2 Severability; Entire Agreement; No Waiver; Assignment
Invalid provisions are modified to the minimum extent or severed, the remainder continuing in force. These Terms plus the Driver Privacy Policy constitute the entire agreement on driver services, superseding prior versions. Failure to enforce is not a waiver. You may not assign your rights without EVODOO's written consent; EVODOO may assign to affiliates, successors, or acquirers.
20.3 Force Majeure
Neither party is liable for delays or failures caused by events beyond reasonable control (natural disasters, epidemics, unrest, war, terrorism, government action, power or network failures). Obligations suspend to the extent affected, with reasonable notice and resumption efforts.
20.4 Governing Law & Jurisdiction
These Terms are exclusively governed by the laws of the Kingdom of Morocco. Disputes are first subject to good-faith negotiation for 30 days; failing resolution, they fall under the exclusive jurisdiction of the Competent Commercial Courts of Agadir, Morocco.
